A bit about regulatory czar, Cass Sunstein.

“WASHINGTON — Cass Sunstein, a Harvard Law School professor who pioneered efforts to design regulation around the ways people behave, will be named the Obama administration’s regulatory czar, a transition official said Wednesday.

Mr. Sunstein, a friend of President-elect Barack Obama from their faculty days at the University of Chicago law school, will mark a sharp departure for the White House Office of Information and Regulatory Affairs. Although obscure, the post wields outsize power. It oversees regulations throughout the government, from the Environmental Protection Agency to the Occupational Safety and Health Administration….

…..Mr. Sunstein, a prolific academic with wide-ranging interests, may be best known for advancing a field known as “law and behavioral economics” that seeks to shape law and policy around the way research shows people actually behave. The theory builds on earlier approaches developed at the University of Chicago law school that sought to harmonize regulatory law with free-market economics. Although widely embraced by conservatives, critics said it failed to account for the sometimes less-than-rational aspects of human behavior….. ”

Obama czar proposed government should ‘infiltrate’ social network sites, chat rooms, message boards.

Just prior to his appointment as President Obama’s so-called regulatory czar, Cass Sunstein wrote a  lengthy academic paper suggesting the government should “infiltrate” social network websites, chat rooms and message boards.

Such “cognitive infiltration,” Sunstein argued, should be used to enforce a U.S. government ban on “conspiracy theorizing…..”

Drive with caution.

SOPA:

SOPA gives the government and thus their administrative paws jurisdiction to deal with issues that arise from copyright infringement. What is shocking is how quickly it has been made to appear that a civil matter is some how cart blanch a criminal one.

I am going to be watching for the net tax and it looks like it might get its first kick off with the proposed Internet ID from this administrations todo pile.

The ID would be a way to create more application processing, resolution, transactions, disputes, courts, legal challenges… in short it would secure some jobs and perhaps create some more for those working in government, not to mention the real jewels all that control over all the information about you. In any event they will find a way for you to pay for it and more than likely it will be in the form of a tax or license renewal scheme…..

The only truly good thing about this is it would provide great tools and intel to stop some pretty depraved people who long and seek to truly harm our young, families, oubusiness interests, reputations, peaceful security, and all manner of fraud.

Imagine getting pulled over on the cyber highway for downloading at 26 mgs in a 3 mg, max zone… First off how did you get on to this much bandwidth and is your net ID in good standings? Imagine if the administration had a right to question such things, and even fine  / imprison as they regulate and see fit. Do not forget political dissidence has a whole bunch of other Czars and Departments to deal with it.

MONEY AND ENTERPRISE

OK so what is to happen to Google? Youtube… They have the technology to filter out the copyrighted material (for the most part) so what is the reaction and game plan for stakeholders in the way the net is used today?

Google is rumored to be contemplating this: Google May Break Ties With US Chamber Of Commerce Over SOPA

“Sources close to Google claim that the search giant is mulling the possibility of breaking ties with the US Chamber of Commerce. The issues stem from the Chamber’s strong support for the Stop Online Piracy Act (SOPA), and Google’s staunch opposition to it. SOPA and the E-PARASITE provisions from the US House would essentially saddle Google and other tech firms online with the task of policing web sites for copyright-infringing behavior.”

Yahoo has already ditched them, they (U.S. Chamber of Commerce ) are a very powerful lobby group who have many members with deep pockets, both in Hollywood and media, and in Washington as well. Google leaving is likely to be a key signal other heavy hitters in Americas tech sector to follow suit and prepare to dig into position for a long battle.

How is the American tech sector going to thrive with this kind of breakdown in alliances? eBay and company craigslist have no qualms about speaking out about SOPA. They are saying that what they do and how they operate is in jeopardy and as such who would want to stay in their stock or even the tech sector period.
